Volvo considering action on EU toll decision-FT

LONDON, April 25 (Reuters) - Sweden's AB Volvo is considering legal action against EU regulators if they approve a deal for DaimlerChrysler AG and Deutsche Telekom AG to collect German road tolls, the Financial Times reported on Friday.

Sources familiar with the situation told Reuters on Thursday the European Commission is set next week to conditionally approve a venture between Deutsche Telekom and DaimlerChrysler for an electronic road toll system in Germany.

The two firms, together with French road operator Cofiroute, a unit of construction firm Vinci SA , won a contract from the German government to build the system, which will initially serve heavy trucks on German roads.

The Financial Times said Volvo was concerned that the joint venture would give DaimlerChrysler a monopoly in the market for lucrative high-technology services to transport companies.

"The European Commission is creating a monopolistic situation, giving DaimlerChrysler a competitive advantage," the paper quoted Stefan Lorentzson, the head of Volvo's European Union representation, as saying.

The newspaper also quoted Lorentzson as saying a challenge to the commission's clearance in the European Court of Justice was an option, but no final decision had been made.
